1. Terms of Trade

• All payments are due immediately upon completion of work unless prior written credit arrangements are made.
• Accepted payment methods: EFTPOS, credit card, or cash.
• Emergency Fuel Recovery reserves the right to hold the vehicle until payment for the service is made in full.
• Any unpaid amounts may be subject to late fees and recovery costs.

2. Acknowledgement & Release

• Emergency Fuel Recovery identifies faults caused by misfuelling and advises Customers of potential consequences.
• The customer acknowledges that misfuelling (using the incorrect fuel type) can cause significant damage to the vehicle’s engine and fuel system, particularly if the vehicle is started after the incorrect fuel has been added.
• Customers release Emergency Fuel Recovery from liability for damages arising from the misfuelling act itself.
• If a vehicle is deemed unsafe/un-roadworthy, the Customer must arrange towing/transport at their own expense.

3. Fuel Disposal & Retention

• – Drained fuel may only be retained in approved AS/NZS 2906:2001 compliant containers, clearly labelled and not ordinarily used for foodstuffs.
• In most cases, drained fuel cannot be retained. Emergency Fuel Recovery reserves the right to refuse requests to retain drained fuel.
• Customers accept full responsibility for the safe disposal of any retained fuel in accordance with the Environmental Protection Act 1986.
• Emergency Fuel Recovery accepts no liability for subsequent use of drained or retained fuel.

4. Service Limitations

• Emergency Fuel Recovery operates within designated service areas. Services requested outside these areas may incur additional fees or may be refused.
• Estimated response times are indicative only and may vary due to traffic, weather, or unforeseen events.
• We do not guarantee that our service will prevent or repair all damage caused by misfuelling.

5. Cancellations & Refunds

• A cancellation fee may apply if the Customer cancels a booking after a technician has been dispatched.
• Refunds are not provided once work has commenced.
• Where services cannot be provided due to circumstances beyond our control, Emergency Fuel Recovery may issue a partial or full refund at its discretion.

6. Liability

• Emergency Fuel Recovery’s liability is limited to the cost of the service provided.
• We are not liable for: loss of use of the vehicle, consequential or indirect damages, costs associated with repairs beyond the service provided, or Customer’s failure to follow post-service instructions.
• Nothing in these Terms excludes liability where prohibited by law (e.g. consumer rights under the Australian Consumer Law).

7. Customer Responsibilities

• Provide accurate details when booking (vehicle make, model, fuel type, location).
• Ensure safe access to the vehicle at the agreed service location.
• Follow all safety advice given by our technicians.

8. Privacy Policy

• Emergency Fuel Recovery collects and stores Customer information only for the purpose of providing services and processing payments.
• Personal data will not be shared with third parties except as required by law or with Customer consent.

9. Governing Law

• These Terms are governed by the laws of New South Wales, Australia.
• Any disputes will be subject to the jurisdiction of the courts in New South Wales.

10. No Start No Pay Policy

• Emergency Fuel Recovery operates under a No Start No Pay Policy.
• If, after completing our misfuel recovery process, your vehicle does not start, you will not be charged for the service (excluding any agreed call-out or cancellation fees).
• This policy does not apply if: the vehicle has pre-existing mechanical or electrical issues unrelated to misfuelling; the Customer provided inaccurate information that affected the outcome of the service; or the Customer refuses to follow post-service instructions provided by the technician.
• Emergency Fuel Recovery reserves the right to determine, at its sole discretion, whether the ‘No Start No Pay’ condition applies.
